TERMS AND CONDITIONS

Introduction:

The order of products presented in the electronic catalog of the website is subject to the client's acceptance of all the general terms and conditions of sale set out below.

These general terms and conditions of sale are binding on the client to the exclusion of all other conditions, particularly those in force for in-store sales, and without regard to any special clauses added by the client – unless expressly agreed by the seller – or to any advertising documents issued by MOJO CONNECTION or any other document.


1. Acceptance

The client's acceptance of these terms is materialized by their electronic signature, confirmed by the "click to confirm," as well as by the provision of their banking details for the payment of the order. This electronic signature has the same legal value as a handwritten signature between the parties. This double action equates to the client acknowledging that they have fully read and unconditionally approve all of these terms.


2. Products

The product presentation photographs in the electronic catalog aim to describe and present the items as accurately as possible. However, a supplier may slightly modify an item, particularly to improve its quality. Therefore, these photographs cannot be considered as part of the contractual scope, and minimal variations in the representation of the items cannot hold MOJO CONNECTION responsible nor affect the validity of the sale.


3. Availability

Our product and price offers are valid as long as they are displayed on the site, subject to stock availability. Information on product availability is provided to the client at the time of order placement. In the event of unavailability after the order has been placed, we will inform the client by email and commit to either providing replacement items with similar or superior features and quality at an equal or higher price, or refunding the client if their bank account has been debited.


4. Order

Automatic registration systems are considered proof of the nature, content, and date of the order; MOJO CONNECTION confirms the acceptance of the order to the client at the email address provided by the client. The sale will be concluded only upon confirmation of the order. MOJO CONNECTION reserves the right to cancel any order from a client with whom there is a dispute regarding payment for a previous order. Products will only be delivered to the address specified by the client during the ordering process. The information provided by the client during the order process is binding on them: in the case of an error in the recipient's details, the seller cannot be held responsible for the inability to deliver the product.


5. Delivery

After confirmation of the order, MOJO CONNECTION commits to deliver all the references ordered by the buyer to its carrier within a maximum of 30 days (from the day after receiving the order).

Products purchased on the site are delivered within mainland France by carrier.

Deliveries to EU countries are made by the carrier’s Europe service or by La Poste.

The indicated delivery times are average usual times, corresponding to processing and delivery times. In the case of items with different delivery dates, depending on availability, the delivery time is based on the longest time; MOJO CONNECTION reserves the right to split deliveries, and only the products that have been shipped will be charged. The processing and shipping fee will only be charged for one shipment.

MOJO CONNECTION cannot be held responsible for consequences due to delivery delays.

If the carrier is unable to deliver the order (client absent, incorrect address, etc.), they will inform the client of the situation by phone or mail. Any undelivered order not claimed by the client within 7 days after this notification will be returned to MOJO CONNECTION. Return shipping costs will be charged to the client, and will be communicated by email with proof. The client is obligated to pay these return fees. If the client requests a reshipment of their order, they must cover the reshipment fees, which will be estimated upon request.

Any order not shipped within 30 days of the order will be canceled unless otherwise stipulated and announced in the sales offer.
In the case of a pre-order, the thirty-day period starts from the official release date of the pre-ordered product.

The client must notify the carrier and MOJO CONNECTION of any reserve on the delivered product (damaged package, already opened...) within three days following the receipt of the product. In the case of a technical product, the client should particularly verify the proper functioning of the delivered device and read the user manual provided.

In the event of apparent defects, the client benefits from the right of return under the conditions provided in this document.

Furthermore, for deliveries outside mainland France, the client agrees to pay all import taxes, customs duties, VAT, and any other taxes due under the laws of the country of receipt of the order.

In the case of pre-order, MOJO CONNECTION commits to deliver all the references ordered by the buyer to its carrier within a maximum of 15 working days after the official release date of the pre-ordered product.


6. Force Majeure

Events such as war, riots, fire, strikes, accidents, and inability to obtain supplies are considered as force majeure, relieving the seller of their obligation to deliver. Goods always travel at the risk of the recipient. The client must verify their package upon arrival. They have 48 hours to report any issues (missing items, damage) to the carrier.


7. Withdrawal

In accordance with Article L 121-16 of the Consumer Code, the individual client has a period of 15 full days from receipt to return any unsatisfactory items to MOJO CONNECTION, except for customized items (such as embroidered or printed), for exchange or refund, without penalty, except for return shipping costs, which remain the responsibility of the client.

Returns must concern new items in their original packaging, along with all accessories, user manuals, and documentation. Returns should be sent by registered mail with a signature to:

Items returned incomplete, damaged, used, or opened will not be accepted.

In case of abnormal or abusive returns, MOJO CONNECTION reserves the right to apply a discount on the price of the returned product or retain handling fees to cover incurred costs.

In the exercise of the right of withdrawal, MOJO CONNECTION is required to refund the sums paid by the client, without charge, except for return shipping fees. The refund must be made within a maximum of 30 days.


8. Price

The price is expressed in Euros.

The price indicated on the product pages does not include shipping costs.

The price charged to the client is the price indicated in the order confirmation sent by MOJO CONNECTION; this price is expressed including all taxes and includes VAT for France and EU countries; it covers the price of the products, handling, packaging, and storage fees, shipping fees, and setup costs.

If the client has a discount code, they will enter it during the checkout process in the designated field. Unless otherwise stated, discount codes cannot be combined. Moreover, once the order is validated and paid, it is no longer possible to add a discount code afterward.

MOJO CONNECTION reserves the right to modify prices at any time. However, for any accepted order, MOJO CONNECTION guarantees the prices applied on the order confirmation date.


9. Payment

The price of the products is payable in full on the day the order is placed, and payment is made by credit card (CB, MASTERCARD, VISA), check, or bank transfer.

Our site is secured: we have adopted the PAYPLUG encryption process.

Online, PAYPLUG allows the client to pay through a secure server. The client's credit card number is directed to the bank's servers, and the payment is made directly to the bank in a secure environment, without passing through the store’s server, which is even more secure as the card numbers are only known to our banking partner (QONTO).

The order validated by the client will only be considered effective when the payment centers concerned have given their approval. In case of refusal by these centers, the order will be automatically canceled and the client will be notified by email. Furthermore, MOJO CONNECTION reserves the right to refuse any order from a client with whom there is a dispute.

11. Intellectual Property

The site is owned by MOJO CONNECTION in its entirety, along with all associated rights.

All texts, works, illustrations, and images reproduced on the site are reserved under copyright law and intellectual property law worldwide. As such, and in accordance with the provisions of the Intellectual Property Code, only private use is authorized, subject to different or more restrictive provisions in the Intellectual Property Code.

Any full or partial reproduction of the site is subject to authorization from MOJO CONNECTION.


12. Liability

The products offered comply with French law and applicable standards in France. The liability of MOJO CONNECTION cannot be engaged in case of non-compliance with the legislation of the country where the product is delivered. It is the client's responsibility to verify with local authorities the importation or usage possibilities of the products.

The liability of MOJO CONNECTION is always limited to the value of the product in question, based on its sale date, and cannot be invoked for simple errors or omissions that may have persisted despite all precautions taken in presenting the products.

In the case of hyperlinks pointing to other sites from the site, MOJO CONNECTION is not responsible for the content of the information provided on these sites once these links are activated.

For sales to professionals, MOJO CONNECTION cannot be held liable for any damages resulting from a professional activity (loss of business, loss of profit, loss of opportunity, damages, and costs).

All orders placed on the site are for the personal use of the buyer, either for personal use or for the resale of products within the framework of the distribution.


13. Data Protection

In accordance with the Data Protection Act of January 6, 1978, you have the right to access, modify, correct, or delete your personal data. To exercise this right, simply send us a request by email.


14. Applicable Law

French law governs the sale of products on the site.

Any dispute will fall under the jurisdiction of the competent court of Nantes.
